Darrick..here's two versions of the same joint custody idea: the Equal Parenting Bill ( " equal time for both parents unless one parent is unfit, unwilling or unable") should be reintroduced again....or back in 2003, Ivey Shelton and others promoted another version of the Equal Parenting concept with a bill that would create a presumption that in every custody contest each parent would be "presumed" to be equal on the 12 custody factors unless one parent proved otherwise against the other parent by clear and convincing evidence. The critics said "we dont like "presumptions"..I said Michigan law is full of presumptions and some work just fine...ie the "presumption" in the parenting statute that it "is in the best interests of a child " to have parenting time with his parents...so why not custody??
